The Oaths and Affirmations Act 2018 is now in effect

The Oaths and Affirmations Act 2018 (Vic) came into effect on 1 March 2019. The Act consolidates Victorian laws relating to oaths, affirmations, affidavits and statutory declarations. This legislation updates processes for affidavits and provides a clear process for certifying documents.

All affidavits filed with the Court will be checked to ensure they meet the Act’s requirements, as well as the Court Rules requirements.

Affidavit and statutory declaration forms may be found on the Forms and Fees page of the Court’s website. Affidavits that do not comply may not be accepted for filing by the relevant Court Registry.
