Civil Procedure Rules remade

The Civil Procedure Rules have been remade: the 2018 Rules commenced on 19 November 2018.

The County Court Civil Procedure Rules 2008, which constitute Chapter I of the Rules of the County Court, expired on 20 November 2018. These Rules regulate procedures in the Court in relation to civil proceedings. The new 2018 Rules commenced on 19 November 2018.

The new Rules are substantially the same as the 2008 Rules, however practitioners should note changes such as those listed below:

  • Amendments to e-filing rules (Order 28): this is now the compulsory method for solicitors to file documents (unless the Court orders or a Registrar directs otherwise), and removal of requirement for a filing confirmation notice for originating processes to be issued;
  • Removal of the requirement to file medical reports in sealed envelopes (O33.10(3)); and
  • Removal of the requirement to file a Certificates of readiness (Order 48 revoked).

This is not an exhaustive list of amendments, and practitioners should familiarise themselves with all changes to the Rules.
