Commercial Division: Indicative Time to Trial, Not Reached and Time to Judgment figures

INDICATIVE TIME TO TRIAL IN THE COUNTY COURT

As part of the Court’s commitment to the International Framework for Court Excellence adopted in 2010, the Commercial Division publishes quarterly updates of the indicative time period in months from First Administrative Mention to the first available trial date. The time periods published below reflect the most current assessment by the Division of the time to trial based on the number of judges available to hear trials over the listing period and may thus be subject to variation as circumstances change.

AVERAGE TIME TO JUDGMENT

The Commercial Division hears a diverse range of often complex commercial disputes with quantum ranging from several hundred thousand dollars to many millions of dollars. The time to judgment will depend upon a number of factors, including the complexity of the proceedings and the workload of the trial judge.

The below figures represent the number of matters which were marked Not Reached in the calendar year to date. When a matter is marked Not Reached it indicates there was no judge available to hear the matter on the day it was listed for trial. The Commercial Division understands the importance of providing certainty of trial date to commercial litigants and actively manages its lists in order to keep the number of not reached cases to an absolute minimum. In the unlikely situation that a case is not reached it may be offered a Judicial Resolution Conference before a Judicial Registrar and will be re-listed with priority.
